Proposition 65 Warning

Q: What does the Prop 65 warning I found on my Kalorik product mean?

A:  You may have seen the below warning associated with our products, as well as on products purchased from other manufacturers. In fact, if you live in the state of California, you may find this warning on many items in your home, office and even in restaurants:

This warning is the result of a law passed in California in 1986, generally referred to as Proposition 65. It’s a California-only ‘right-to-know law’ rather than a ‘safety law;’ it requires products sold in California to include warning notices about potential exposures to any of the 850+ chemicals or elements identified as causing cancer, birth defects, or other reproductive harm. Any company with products that contain one or more of the listed chemicals must provide a notice to California consumers unless the company can prove that exposure levels are 1000 times less than a scientifically-established safe level.

Q: Does this mean that my Kalorik product is not safe to use?

A: This warning doesn’t mean that a product will cause cancer or reproductive harm, nor does it mean that a product is in violation of any safety standards or requirements. In fact, California has acknowledged that “[t]he fact that a product bears a Proposition 65 warning does not by itself mean that the product is unsafe.” The current Proposition 65 list includes over 850 chemicals, including chemicals used in many foods, dyes, and household items, and the notice requirements can apply even if a product uses very small quantities of a listed chemical. (Click here to read about Proposition 65 in plain language).

Q: So, why do you include this warning?

A: Proposition 65 requires companies to provide a notice for exposures to listed chemicals unless the company can prove that exposure levels are 1000 times less than a scientifically-established safe level. While the exposure level of Prop 65-listed chemicals from the use of Kalorik’s products may be well below the safe level, proving that exposure is 1000 times less than this threshold can be difficult and costly on a per product basis. Consequently, Kalorik has, out of an abundance of caution, opted to provide the Proposition 65 consumer notice. At Kalorik, we monitor and test our products to ensure customer safety and satisfaction, and our commitment is to continuously strive to improve our products in all aspects.

Q: I’m not a California resident. Why am I seeing the warning?

A: Our products are sold nationwide. It would be extremely difficult and costly to control which products will ultimately be sold or bought in California. Therefore, to ensure compliance with Proposition 65 requirements, we have decided to include these warnings on all our products, regardless of destination.
